Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Motorcars.com ("Motorcars," "we," "us," or "our") governing your access to and use of the Motorcars.com website, applications, and related services (collectively, the "Service"). By creating an account, browsing as a guest, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

Motorcars is an automotive community and marketplace platform. We help enthusiasts, buyers, sellers, dealers, businesses, and mechanics discover vehicles, parts, tools, services, events, clubs, networks, builds, and related content, and connect with one another through listings, posts, messages, leads, and other features.

Motorcars provides the platform and tools. Except where we explicitly state otherwise, we are not a party to transactions between users, do not take title to vehicles or goods, do not guarantee the accuracy of listings, and do not provide automotive, legal, financial, or inspection advice.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to create an account. If you use the Service on behalf of a business, dealership, or shop, you represent that you have authority to bind that entity.

You may not use the Service if you have been suspended or banned, if we have terminated your account, or if your use would violate applicable law.

3. Accounts and roles

When you register, you choose an account type (for example, private user, dealer, business, or mechanic). You are responsible for providing accurate registration information and keeping your credentials secure. You are responsible for activity that occurs under your account.

Professional accounts may be subject to additional verification, approval, or ongoing compliance review. We may limit features until verification is complete or if we reasonably believe information is inaccurate or misleading.

You may not impersonate another person, misrepresent your affiliation, create accounts to evade enforcement, or sell or transfer your account without our consent.

4. Acceptable use

You agree not to:

  • Post false, misleading, fraudulent, or illegal listings, offers, or content
  • Harass, threaten, defame, discriminate against, or abuse other users
  • Spam, scrape, crawl, or use automated means to access the Service without permission
  • Circumvent security, rate limits, access controls, or moderation actions
  • Upload malware, attempt unauthorized access, or interfere with the Service
  • Infringe intellectual property, privacy, or other rights of third parties
  • Use the Service for unlawful vehicle sales, stolen goods, odometer fraud, or title washing
  • Collect or misuse personal information of other users without consent
  • Use guest, messaging, or lead features to send unsolicited commercial messages

We may investigate reports, remove content, limit visibility, suspend accounts, or terminate access when we reasonably believe these rules or applicable law have been violated.

5. User content and license

You retain ownership of content you submit (including listings, photos, posts, comments, profiles, event details, and messages), subject to rights you grant below.

By submitting content to the Service, you grant Motorcars a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and adapt that content solely to operate, promote, and improve the Service (for example, showing your listing in search results, sharing a public profile URL, or generating thumbnails).

You represent that you have the rights to submit your content and that it does not violate these Terms or third-party rights. We may remove content that we believe violates these Terms or applicable law.

6. Marketplace, listings, and transactions

Listings, wanted ads, group buys, offerings, and related marketplace content are provided by users. You are solely responsible for the accuracy of your listings, including price, condition, mileage, title status, fitment, availability, and compliance with consumer protection and automotive laws.

Any sale, purchase, trade, service engagement, or offline meeting arranged through the Service is strictly between the parties involved. Motorcars does not escrow funds, guarantee delivery, inspect vehicles, or warrant that any transaction will complete.

Buyers should exercise independent judgment, verify VIN and title information, inspect vehicles and parts in person when possible, and use secure payment methods. Sellers must honor applicable laws governing advertising, disclosures, and dealer licensing in their jurisdiction.

7. Communications, leads, and guests

The Service includes messaging, lead inquiries, appointment requests, guest continuation links, and related communication tools. You agree to use these features lawfully and respectfully.

Guests may browse much of the Service without an account. Certain actions require registration. Guest activity (such as saved items or inquiry history) may be associated with a guest identifier or email and migrated when you create an account, as described in our Privacy Policy.

You are responsible for the content of messages you send. We may monitor or review communications when required by law, to enforce these Terms, to prevent fraud or abuse, or to protect users and the platform.

8. Community features

Clubs, networks, events, posts, comments, follows, and feeds are community features subject to these Terms and any additional rules shown in the product (for example, club membership policies or event capacity limits). Organizers and administrators are responsible for their communities and for complying with applicable law.

We may remove or restrict content or communities that violate these Terms, create safety risks, or generate valid complaints.

9. Fees, subscriptions, and promotions

Some features may be free; others may require paid plans, featured placement, boosts, or other fees. When billing is enabled, prices and billing terms will be presented before purchase. Unless otherwise stated, fees are non-refundable except where required by law.

We may change pricing or introduce new paid features with notice where required. Continued use after a fee change constitutes acceptance of the new pricing for renewal periods, unless you cancel before renewal.

10. Intellectual property

The Service, including its design, software, logos, and branding, is owned by Motorcars or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

If you believe content on the Service infringes your copyright or other rights, contact support@motorcars.com with sufficient detail for us to evaluate your claim.

11. Suspension and termination

You may stop using the Service at any time. You may request account closure through support or account settings where available.

We may suspend or terminate your access, remove content, or restrict features at any time if we reasonably believe you violated these Terms, created risk for users or the platform, or if required by law. Where practical, we will provide notice, but we may act immediately for serious violations.

Sections that by their nature should survive termination (including licenses granted to Motorcars, disclaimers, limitations of liability, and indemnification) will survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTORCARS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT LISTINGS, USERS, OR THIRD-PARTY CONTENT ARE ACCURATE OR RELIABLE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTORCARS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTORCARS'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID MOTORCARS IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Motorcars and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your listings or transactions, your violation of these Terms, or your violation of any law or third-party rights.

15. Disputes and governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your home jurisdiction apply.

Before filing a claim, you agree to contact us at support@motorcars.com and attempt to resolve the dispute informally. If we cannot resolve a dispute within 30 days, either party may bring a claim in the state or federal courts located in Delaware, and each party consents to personal jurisdiction there, except where prohibited by applicable law.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date. For registered users, we may also provide additional notice (for example, by email or in-product notice). Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
